Defendant shall be punished by a fine of KRW 1,500,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. Larceny;
A. The Defendant, at around 05:30 on February 8, 2013, at the “Caturel in Ansan-si, a member B” in the “Catura” located in Ansan-si, a group of members, with the victim D, and then taken one copy of the “SK” credit card, which is the victim’s possession, from the wall located above the victim’s locked between the victim and the locked.
B. At around 04:30 on February 17, 2013, the Defendant: (a) 2.10,000 won in cash, KB credit card; and (b) 1 credit card; (c) 2.1,000 won in cash, which is owned by the victim, from the victim’s wall located on his/her computer book, to the victim’s wall located on his/her own, regardless of whether the victim was locked.
Accordingly, the defendant stolen the victims' property.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On February 8, 2013, around 14:36, the Defendant: (a) purchased clothes at the “J” clothing store operated by the victim I on the first floor of H in Ansan-si building, Ansan-si; and (b) presented the Plaintiff with one SK credit card as if the Defendant was a credit card company, and signed the sales slip, in order to settle the clothes value equivalent to KRW 169,500, as described in paragraph (a) of Article 1.
Accordingly, the defendant, by deceiving the victim, exempted the payment of 169,500 won, acquired the same amount of financial benefits, and used stolen credit cards.
B. On February 8, 2013, around 14:43, the Defendant issued the sales slip to the victim as if he was the credit card holder of the Defendant, and signed the sales slip, at the “M” (M) clothes store operated by the victim L on the first floor of the K apartment in Ansan-si, Ansan-si, in order to settle the clothes value equivalent to 39,000 won after purchasing clothes.
Accordingly, the defendant, by deceiving the victim, exempted the payment of 39,000 won, acquired the same amount of financial benefits, and used stolen credit cards.
C. On February 8, 2013, around 14:46, the Defendant’s clothes from the “M” clothes store operated by the victim L in the K apartment first floor in Ansan-si, Ansan-si.
