A defendant shall be punished by imprisonment for not less than five months.
Reasons
Punishment of the crime
On February 8, 2011, the Defendant was sentenced to imprisonment with prison labor for night building intrusion larceny at the Busan District Court, and on October 21, 2011, completed the execution of the punishment in Seongdong-gu District Court on October 21, 201.
1. From August 6, 2012, around 19:20 on August 6, 2012, the Defendant: (a) discovered that the entrance door of the F body-manman Vehicle of the victim parked in Bupyeong-gu Incheon Metropolitan City was even opened; and (b) cut off the victim’s corporate bank BC credit card and NH credit card, which were kept in the contact room, of the victim’s bank BC credit card and NH credit card.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On August 6, 2012, at around 20:47, the Defendant issued an order for drinking and drinking alcohol at the “H” main point of the operation of the victim’s nameless box located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, for the purpose of settling the drinking value equivalent to KRW 30,000,000, the Defendant presented the stolen Category BC credit card to the victim as if he was the Defendant’s credit card, and signed the sales slip.
Accordingly, the defendant, by deceiving the victim to pay 30,000 won, acquired the same amount of property benefits, and used stolen credit cards.
B. On August 6, 2012, at around 21:00, the Defendant presented D’s BC credit card as if the Defendant was the Defendant’s credit card, and signed the sales slip, in order to pay the amount equivalent to KRW 100,000,00 after having singing and drinking in “Jsing” in the operation of the victim’s name and unsing boxes located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu.
Accordingly, the defendant, by deceiving the victim, exempted the payment of KRW 100,000,00, acquired the same amount of property benefits, and used stolen credit cards.
C. On August 6, 2012, around 21:10 on August 6, 2012, the Defendant ordered the two shares at the “Jsing” in the “Jsing” operation of the victim’s nameless boxes located in Bupyeong-gu Incheon Metropolitan City.
