A defendant shall be punished by imprisonment for five years.

The defendant shall order the completion of a sexual assault treatment program for 120 hours.

Punishment of the crime

1. 성폭력범죄의 처벌 등에 관한 특례법위반( 장애인 위계 등 추행) 피고인은 지적 장애 3 급의 정신 적인 장애가 있는 피해자 C( 여, 22세) 이 재학 중인 D 학교의 바리스타 교육 학생 반장으로, 2015. 10. 13. 17:03 경 군포시 E 소재 F 지하철역 안에서 일행과 헤어진 피해자에게 다가가 “ 어디서 뵌 분 같은데, C 씨 아니 세요 ”라고 말을 걸며 피해자를 따라 승강장 안으로 들어와 그 곳 벤치에 앉아 있는 피해자의 왼쪽에 앉아 자신의 점퍼를 벗어 피해자 몸 위로 덮은 후 피해자의 옷 안으로 손을 넣어 피해자의 배, 가슴, 음부를 만졌다.

Accordingly, the defendant committed an indecent act against the victim with mental disability by force.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (e.g. between disabled persons);

A. On October 13, 2015, the Defendant: (a) committed an indecent act against the victim, as described in paragraph (1) around 17:15, and opened 7 p.m. from the victim’s hand to prevent the victim from spreading the iron; and (b) made a false statement to the victim “(s) going to go to the victim by introducing the victim’s specialty (to be capable of working by the victim), going to a coffee specialty; (c) going to go to the victim; and (d) moved to the victim with a male toilet between the first floor and the second floor in the F Station; (d) opened the toilet, kid the victim’s shoulder; (d) opened the victim’s chest, fry, and frighting the victim’s shoulder; and (d) opened the victim’s lower part of the victim by inserting him/her into the victim’s mouth and inserting him/her into the victim’s inner part; and (d) opened the victim’s end and rear the victim’s sex by inserting him/her into the victim’s body.

B. The Defendant (a) committed the crime described in the above paragraph (a) and putting the victim into the library, leading the victim’s loss from the library, and led the victim’s loss on October 13, 2015.
