Since four years ago, the defendant started de facto marital relationship with C, a mother of the victim B (n, 27 years of age, intellectual disability 3 level), and resided with C and the victim in the residence of C in Busan-gu, Busan-gu.

1. 성폭력범죄의 처벌 등에 관한 특례법 위반( 장애인 강간) 피고인은 2017. 10. 27. 내지 같은 달 28. 경 위 주거지에서 잠을 자다가 깨어 피해자를 간음하기로 마음먹고, 피해자의 방에 몰래 들어가 그 곳에서 잠을 자고 있는 피해자를 조용히 부르고, 이에 깜짝 놀란 피해 자가 소리를 치려 하자 손으로 피해자의 뺨을 1회 때리고 입을 막아 반항하지 못하게 한 후, 손으로 피해자의 가슴을 주무르듯 만지고, 피해자의 하의를 벗긴 후 팬티를 옆으로 젖혀 피고인의 손가락을 피해자의 음부에 삽입한 뒤 계속하여 피고인의 성기를 피해자의 음부에 삽입하여 정신 적인 장애가 있는 피해자를 폭행하여 강간하였다.
