A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a national spouse (F-5-2) foreigner of Vietnam who is staying in Korea with his/her status of stay.

1. On November 2018, the Defendant forged a private document: (a) requested the forgery of a motor vehicle driver’s license to D (the confirmation of conviction on July 19, 2019) which is a huber for arranging the forgery of a motor vehicle driver’s license through the Internet Facebook, and sent the Defendant’s passport, alien registration certificate, evidentiary photograph, etc. as a photograph; (b) requested D to manufacture a fake motor vehicle driver’s license in the name of the Vietnam traffic father in a non-fluent manner; and (c) obtained D to have D manufacture a fake motor vehicle driver’s license in the name of the Vietnam traffic father in a non-fluent manner.

Accordingly, the defendant, in collusion with D, forged a driver's license in the name of the Vietnam Transport Department, which is a private document about a certificate of fact, for the purpose of uttering.

2. On December 4, 2018, the Defendant filed an application for the exchange of a foreign driver’s license with a Korean driver’s license in the Daegu-gu driver’s license test site located in Taenam-ro 38, Taenam-ro, Daegu-gu, and subsequently filed an application for the replacement of a foreign driver’s license with a Korean driver’s license. As described in the foregoing paragraph, a public official in charge of being aware of the forgery submitted to the public official as if the driver’s license was duly formed

3. The Defendant was issued a Korean driver’s license under the name of the Superintendent of the Daegu Provincial Police Agency to the public official in charge by submitting a forged Vietnam driver’s license, at the time and place mentioned in the above 2. Paragraph (2).

As a result, the defendant interfered with legitimate execution of duties concerning the issuance of foreign licenses by public officials belonging to the Daegu Driver's License Test Chapter.
