Defendant shall be punished by imprisonment for not less than three years and six months.
Reasons
Punishment of the crime
On April 14, 2005, the Defendant was sentenced to one year of imprisonment with prison labor and two years of suspended sentence for larceny in Seoul Western District Court on September 28, 2005, sentenced to two years of imprisonment with prison labor for violating the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) in the Daegu District Court Kimcheon Branch on September 28, 2005, and sentenced three years of imprisonment with prison labor in the Daejeon District Court on November 5, 2008, and completed the execution of the sentence in the Chungcheong Detention House on August 16, 201.
1. On October 8, 201, the Defendant: (a) discovered that the door of G Mtz vehicles in the market value of KRW 5 million owned by the victim parked in the said place is opened on the way located in Gumi-si, Gumi on October 18, 2011; and (b) discovered the vehicle into the said vehicle and stolen the vehicle by walking along the vehicle as a key attached to the said place and driving the vehicle.
Accordingly, the defendant habitually stolen the victim's property.
2. The Defendant violated the Road Traffic Act (unlicensed Driving) without obtaining a driver’s license over three occasions as follows, driving a mast car which was stolen as above.
At around 18:00 on October 8, 201, the Defendant driven the said car from the front day of the Si-U.S., Si-S., to the roads near the Gu-U.S., Si-S., Si-S., Si-S., 19:30 on the same day.
B. On October 11, 201, at around 22:00, the Defendant driven the said car to the front road of the two-class parks located in Daegu-gu, Daegu-gu, at around 04:00, via the Seongbuk-gun and Daegu-gu, Seongbuk-gu, Seongbuk-do.
C. On October 13, 201, at around 17:00, the Defendant driven the said car from the roads near the second grade park located in the Daegu Seo-gu, Daegu-gu to the roads front of the principal fire station in the Seo-gu, Daegu-gu.
