Defendant shall be punished by a fine of 2.5 million won.

If the defendant fails to pay the above fine, 50,000 won shall be one day.

Punishment of the crime

A is a person who actually operates Company I, and the defendant is a fishing vessel owner.

A developed LED (ELD) with oil-saving devices, etc., and received orders from vessel owners, but in order for vessel owners to install the said fish, etc., A is required to bear one million won per ship, but the project of installing the said fish-conditioning, etc. was very poor for the competent authorities to pay subsidies to the owners of fishing vessels.

Accordingly, A decided to hold L, M, N, and meetings, which are employees in charge of the business of the above company, to order the owners of fishing vessels to take measures to install fish, etc. on condition that they would bear the self-charges of the owners of fishing vessels as above in the company.

Since then, on December 2009, A and the employees in charge of the above businesses made a request to the competent authorities for the submission of a subsidy application as if the company actually bears the cost of the shipowner's self-payment from the company as stated above.

Accordingly, the Defendant, in collusion with A, L, M, and N on December 2, 2009, was to bear the full amount of the charges by the Defendant, who is the owner of a fishing vessel, without bearing all the charges as above. However, as if the owner of a fishing vessel was to bear the charges, the Defendant prepared a certificate of deposit of his own funds to the Fisheries Cooperatives at Jeju City, which proves that the owner of the vessel deposited his own funds into the high-efficiency fishing vessel oil reduction equipment support project, and submitted it to the Fisheries Cooperatives at Jeju, which is aware of the fact, to attach the certificate of deposit of his own funds to the documents attached to the application for the subsidies for high-efficiency fishing vessel oil reduction equipment support project. The Defendant, as the owner of the fishing vessel, submitted the application for the said subsidies and the accompanying documents to the public officials in charge of maritime affairs and fisheries and the public officials in charge of maritime affairs and fisheries at this time.
