A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2019 Highest 2826] No person shall arrange to give or receive money or other property benefits to an unspecified person, in return for promising him/her to give or receive such money or other property benefits, and engage in similar intercourse using a part of his/her body, such as sexual intercourse and mouth, or implements.

Nevertheless, from May 22, 2019 to June 13, 2019, the Defendant, in the Goyang-gu C Officetel D, employed women with the nationality of the mother country as women of sexual traffic, advertised the said establishment with the trade name of "J" in the name of "F (G)" and "H (I)," which is the Internet sexual traffic advertising site, and reported the advertisement, received 160,000 won from many unspecified male customers at KRW 80,00 according to the frequency and time of sexual traffic as the price for sexual traffic from the unspecified number of male customers, and ordered them to do the said sexual traffic women and sexual intercourse by guiding them as the above office.

Accordingly, the defendant arranged sexual traffic for business purposes.

1. No one shall arrange any act of creating similarity using a part of the body, such as sexual intercourse, mouth and anus, or implements in return for giving, receiving, or promising to give, any money, valuables or other property benefits to an unspecified person;

Nevertheless, from the end of June 2019 to August 22, 2019, the Defendant employed a foreign woman with the nationality of the Thailand as a female of sexual traffic, advertised the said business with the trade name of “M” to “H (L)”, which is an Internet sexual traffic advertising site, and received 80,000 won or KRW 180,00 according to the frequency and time of sexual traffic from many unspecified male customers who discovered the advertisement, and ordered the said female sexual traffic and sexual intercourse by guiding them as an officetel.

Accordingly, the defendant arranged sexual traffic for business purposes.
