A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[criminal power] On March 25, 2008, the Defendant was issued a summary order of KRW 700,000 by the Daejeon District Court to a fine for a violation of the Road Traffic Act. On March 28, 2012, the Defendant was issued a summary order of KRW 4 million by the Daejeon District Court for a violation of the Road Traffic Act.
【Criminal Facts】
1. On February 25, 2013, the Defendant was driving a DNA Lone Star Vehicle from the front of the Han field playground located in the Jung-gu, Daejeon District under the influence of alcohol at 0.086% of alcohol level on February 21, 2013 to the fourth road of the Daejeon Dong-gu, Daejeon.
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a Dsch Rexroth vehicle.
On February 25, 2013, the Defendant driven the above vehicle on February 21, 201:30, and proceeded at a speed of 50 km from the south Daejeon Island to the south Daejeon (h) by using three lanes between the six-lane of the Do.
