A defendant shall be punished by imprisonment for one year.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

1. 2. 특수협박 피고인은 1항 기재 일시, 장소에서 위와 같이 피해자 B을 폭행한 후 피해자 B에게 주먹으로 얼굴을 맞게 되자 격분하여 선내 식당으로 가서 그곳에 있던 흉기인 식칼(총 길이 30cm, 칼날 길이 20cm, 너비 5cm)을 가져와 피해자 B에게 “씨발놈아 죽을래 콱 찔러블라”라고 소리치며 식칼의 칼날을 피해자 B을 향해 흔들어 공격할 것처럼 위협하고, 다른 선원들에 의해 식칼을 빼앗기자 다시 식당으로 가서 흉기인 다른 식칼(총 길이 30cm, 칼날 길이 20cm, 너비 5cm)을 들고 선미 갑판으로 나와 피해자 B에게 달려들려고 하여 피해자 B을 협박하였다.

3.
