1. Basic facts

A. The gold Repair Association was established on April 1, 1952 by the former Joseon Repair Association Order (amended by Ordinance No. 2 of July 2, 1917, repealed by Act No. 948, Dec. 31, 1962), and was merged with the other Repair Association on November 30, 1961.

In accordance with paragraph (6) of the Addenda of the former Land Improvement Project Act (repealed by Act No. 948 of Dec. 31, 1961, Article 2 of the Addenda of the Rural Community Modernization Promotion Act (Act No. 2199 of Jan. 12, 1970), the Rural Community Modernization Promotion Act was enacted by Act No. 2199 of Jan. 12, 1970, and was repealed by Act No. 2199 of Dec. 29, 195, Article 2 of the Addenda of the Rural Community Modernization Promotion Act (Act No. 5077 of Dec. 29, 1970; hereinafter referred to as the "former Rural Community Modernization Promotion Act") the name of the farmland improvement association was successively changed by Article 3 of the Addenda of the former Farmland Improvement Project Act (Act No. 2199 of Jan. 12, 1970).

The Korea Agricultural and Rural Infrastructure Corporation and Farmland Management Fund (established by Act No. 5759 on February 5, 199, and current name is the Korea Agricultural and Rural Infrastructure Corporation and Farmland Management Fund Act) were established and dissolved pursuant to Article 8 and Article 9 of the Addenda of the same Act and the rights and obligations thereof were comprehensively transferred to the Korea Agricultural and Rural Infrastructure Corporation.

On December 29, 2005, the Korea Agricultural & Rural Community Corporation and the plaintiff on December 29, 2008 changed its name in succession.

B. In around 1952, the Geumsung Water Cooperative commenced the Simsung Pung-si Si Geumsung-si, Geumsung-si, Geumsung-si, and completed the construction of the Simsan-si reservoir around 1959.

C. The land cadastre pertaining to 735 m2,332 m2 (hereinafter “the entire land of this case”) in the Geumcheon-si, Geumsung-si, Geumsung-si, 735 m2,332 m2 (hereinafter “the entire land of this case”) is indicated as the Defendant registered as owner on May 20,

The defendant completed registration of preservation of ownership of the entire land of this case on February 13, 1995.
