A defendant shall be punished by imprisonment for one year.

Punishment of the crime

In fact with C, although the Defendant did not have the intent or ability to repay even if he/she received a loan from a financial institution, etc., he/she conspireds to obtain a loan from a financial institution through a prompt term work loan (such as a false employment certificate, false rental contract, etc. which was obtained a loan by borrowing a vehicle after obtaining a loan from an automobile installment loan, or purchasing a vehicle after purchasing a vehicle with an automobile after re-saleing and using a vehicle, and then not repaid the loan).

1. Fraud by credit loans;

A. On May 20, 2013, in collusion with C, etc., the Defendant: (a) prepared a false employment certificate, health insurance qualification acquisition certificate, etc. as if the Defendant had worked in the company ADS branch from around July 2012, in collusion with C, etc.; (b) prepared a statement of deposit and payment details, payment statement, income tax withholding certificate, etc. as if the Defendant received payment; and (c) submitted the money to a staff member in charge of the victim case loan; and (d) received the loan from the victim around May 20, 2013, the Defendant applied for the loan to the Defendant’s account under the name of the Defendant and received 4850,000 won from the victim on May 20, 2013.

Accordingly, the defendant, in collusion with C, acquired 4850,000 won from the victim case loan corporation.

B. On June 5, 2013, the Defendant, in collusion with C, etc., prepared a false health insurance eligibility acquisition and confirmation as to whether the Defendant had worked in the company Edisypt from February 2, 2013, and filed an application for a loan with the victim mountain and the loan company, and filed an application for the loan to the employee in charge of the name in the company Edispypted from the victim around June 5, 2013.
