Punishment of the crime

1. On February 2013, the Defendant conspired with E and F, etc., and the Defendant did not have any occupation, and did not lease “H apartment 2 and 202” from F’s mother G, the Defendant prepared a false certificate of employment with which he works for the company “(i) Hembpp,” and entered into a false charter contract to lease the said real estate. At that time, the Defendant requested a loan of the pre-paid fund while submitting it to the employee in charge of the name in arrears of the Seoul Seoul branch office located in the Seoul metropolitan branch office, and then received KRW 47 million from the victim.

Accordingly, the defendant, in collusion with E, F, etc., acquired 47 million won from the victim agricultural cooperative.

2. On April 4, 2014, Defendant B, in collusion with Defendant E, etc., prepared a false lease contract with the Defendant to lease the said real estate, even though the Defendant did not have leased “Seoul Seongbuk-gu JBD 302” from E, and around that time, requested a loan of money to a staff member in charge of the name in charge of the new salary branch of the Victim Bank, and then filed an application for the loan of money from the Defendant and then received KRW 120 million from the victim on April 4, 2014.

Accordingly, the defendant, in collusion with E, acquired 120 million won from the victim bank.

3. Defendant C was sentenced to ten months of imprisonment for fraud, etc. at the Seoul Northern District Court on November 28, 2013, and the judgment became final and conclusive on December 2, 2013.

The Defendant, in collusion with E, L, F, and M, prepared a false certificate of employment with which M works for the company “P” and leases the above real estate in collusion with E, L, F, and M, even though the Defendant did not have any occupation for M in the N Office located in Ansan-si Office on January 2013.
