Reasons
Punishment of the crime
[criminal power] On December 1, 2011, the Defendant was sentenced to imprisonment with prison labor for a crime of fraud at the Goyang Branch of the Jung-gu District Court, and on March 15, 201, the Defendant completed the execution of the above punishment added up in the Ganpo Prison on June 5, 2013.

1. On June 14, 2013, the Defendant: (a) around 02:30, the victim D’s “E” operated by the victim D on the Goyang-gu Dayang-gu C Underground 1st, Goyang-gu, Yangyang-gu; (b) despite that the victim D did not have any money or credit card, and did not have an intent or ability to pay the drinking value, the Defendant appears to have expressed an attitude toward paying the drinking value; and (c) received an order for alcoholic beverages equivalent to KRW 400,000,000, including Skb
Accordingly, the defendant, by deceiving the victim, acquired pecuniary benefits equivalent to KRW 400,000 of the drinking value.

2. At around 02:40 on June 20, 2013, the Defendant: (a) H points operated by the Victim G located in Yongsan-gu, U.S., U.S., Manyang-si; (b) was engaged in the act as if he did not have the intent or ability to pay the drinking value; and (c) was provided by the victim with an aggregate of KRW 340,000,000, such as bed and 4 lines of bed and known to the victim.
Accordingly, the defendant was given property by deceiving the victim.

3. Around August 19, 2013, the Defendant made a false statement that the Defendant would do so when paying the retainers to the victim from the “K Sk Standards” operated by the Victim J located in Seocheon-gu, Seocheon-gu I. The Defendant would do so.
However, even if the defendant is paid the retainer, he did not have the intention or ability to do the interior work.
The Defendant received KRW 300,000 from the victim to the Agricultural Cooperative Account under the name of the Defendant as the same day starting money.
Accordingly, the defendant was given property by deceiving the victim.
