Reasons
Punishment of the crime
[criminal records] On July 21, 2016, the Defendant was sentenced to eight months of imprisonment for fraud, etc. in the Goyang Branch of the Jung-gu District Court, and completed the execution of the sentence on March 14, 2017.
[Criminal facts]
1. On November 1, 2017, the Defendant: (a) around 01:50, at the victim D’s “E singing shop” in the victim D’s operation, the Defendant, despite having no intent or ability to pay the price, took place as if he would have paid the price properly; and (b) ordered the victim to provide alcohol and alcohol.
The defendant deceivings the victim as above and was provided with an alcoholic beverage and an alcoholic beverage equivalent to the market price of 140,000 won from the injured party.
2. On November 2, 2017, the Defendant: (a) around 14:30 of the Victim G management (“H”); (b) committed an act as if the Defendant would pay the price properly despite the absence of the intent or ability to pay the price; and (c) ordered the Victim to provide alcohol, alcohol, etc.
The defendant deceivings the victim as above and was provided with 33,00 won or more at the market price from the victim.
3. On November 2, 2017, the Defendant issued an order for alcohol and alcohol to the victim as if he did not have the intent or ability to pay the price, and as if he did not have the intention or ability to pay the price, the Defendant, at around 18:30, ordered the victim to pay the price.
The defendant deceivings the victim as above and was provided with an alcoholic beverage and an alcoholic beverage amounting to KRW 220,000 at the market price from the injured party.
4. On November 10, 2017, the Defendant: (a) around 12:30 of the Victim M management (“N”); (b) committed an act as if the Defendant would pay the price properly despite having no intent or ability to pay the price; and (c) ordered the victim to provide alcohol, alcohol, etc.
Defendant deceiving the victim as above and provided 2,00 won or more at the market price from the injured party.
