A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On February 27, 2012, the Defendant violated the Resident Registration Act: (a) driven a road in the influence of alcohol in front of the 85-18 upper-dong, Jung-gu, Seoul; (b) discovered a slope B belonging to the traffic safety department of the Seoul Jung-gu Police Station; (c) used C’s resident registration number (D) to verify his/her identity.
Accordingly, the defendant used another person's resident registration number unlawfully.
2. The Defendant, at the date, time, and place specified in paragraph (1) of this Article, entered false information into a traffic police network, which is an electronic record of a public office, in a signature column, signed by “C” in order to make the Defendant’s personal information, drinking control results, etc. enter the vehicle into a traffic police network, with a view to making it possible for the Defendant to take part in the management of defective matters by connecting a slope B belonging to the Seoul Central Traffic Guard Station to a traffic police network, and use a forged electronic record by making the electronic record sent to a traffic police network as above.
3. Private signature, forgery, and uttering of a false investigation or signature;
A. While the Defendant was under investigation due to the violation of the Road Traffic Act (driving) at the time, time, and place mentioned in paragraph (1), he forged his signature by entering the above C’s name in the report on the state of his driver, without authority, with the intention of exercising his authority. The Defendant issued the forged state of driver’s administration report to a slope B belonging to the Seoul Central Police Station for the traffic safety of the Seoul Central Police Station as if it had been duly formed, and exercised it.
B. On May 24, 2012, at around 12:16, the Defendant was running in the traffic survey room of the Seoul Southern Police Station located in Jung-gu, Seoul, Jung-gu, Seoul to C, and without authority, entered the above C’s name in an interrogation protocol and forged the above C’s signature with the purpose of exercising the investigation and then without authority.
