Defendant
A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 5,000,000.
The Defendants respectively.
Reasons
Punishment of the crime
Defendant
A is a person holding career certificate of construction technology (construction early and issuance number: D) issued by the Korean Construction Engineers Association, and Defendant B was a representative director of the F Co., Ltd. (former G Co., Ltd.) specialized in the facility maintenance and management business in Ansan-si, Ansan-si.
1. No defendant A’s career certificate of construction technology shall be lent or lent to any third person, and no person shall arrange the lending;
Defendant
A was recommended by A to provide KRW 2,00,000,000 per year from the date of September 2009, to lend a certificate of construction technology (a construction first class) from A, which he/she became aware of through H in the university motive H in September 2009, and was paid KRW 2,00,000 per year in return.
As a result, Defendant A had Defendant A lend the above career certificate of construction technology (a construction beginning level) issued by Defendant A to J Co., Ltd. from February 1, 2010 to December 1, 2010, and lent it to F Co., Ltd. from April 1, 201 to April 1, 2012.
Accordingly, Defendant A did not actually work for the above company and lent his career certificate of construction technology from February 1, 2010 to April 1, 2012.
2. Defendant B did not actually employ K with the aim of meeting the technical capability requirements necessary to maintain the registration of the business of maintaining and managing facilities of the F Co., Ltd., Defendant B, as if Defendant B were employed by the said company by lending only the career certificate of construction technology (construction beginning and issuance number L) issued by the Korea Construction Technology Association from April 1, 201 to April 1, 2012, and pretended to be employed by the said company. Defendant B did not actually employ Defendant A, but only lent the above career certificate of construction technology (construction beginning wage) issued by Defendant A from April 1, 2011 to April 1, 2012, and did not actually employ M, and rather employed by the said company.
