A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

To the extent that there is no substantial disadvantage in exercising the defendant's right of defense, part of the facts charged was revised.

The defendant is the father of the victim B (here, 204) and the victim C (here, 2008).

1. Crimes against the victim B;

Around December 2015, the Defendant committed a physical abuse on the part of the victim, on the ground that the victim B (at the time 11 years of age) does not easily teach the victim C within the building D in Pakistan and the residence in E, and on the ground that the victim B (at the time 11 years of age) is not living together, around December 2015.

나. 2018. 1. 29.경 범행 피고인은 2018. 1. 29. 23:00경 위 가항과 같은 장소에서 피해자 B(당시 14세)과 간지럼 피우는 장난을 하던 중 피해자가 실수로 자신의 얼굴 부위를 긁었다는 이유로, 손으로 피해자의 머리를 잡아 그곳 매트와 벽에 수회 찧게 하고, 무릎을 꿇고 있던 피해자의 어깨를 밀쳐 옷장에 머리를 부딪치게 하는 등 아동의 신체에 손상을 주거나 신체의 건강 및 발달을 해치는 신체적 학대행위를 하였다.
