A defendant shall be punished by imprisonment for not less than eight months.
The defendant shall be ordered to complete 40 hours of sexual assault treatment programs.
Reasons
Punishment of the crime
The defendant is the head of the Gyeyang-gun D Center, and is a person who was in the office of the operation member of the F Center in the visually impaired E and Yangyang-gun.
1. The Defendant violates the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act on the Punishment, etc. of Sexual Crimes) is a relationship in which the Defendant, as an operating member of the F Center, is a person in charge of the overall business while attracting the F Center D Centers, and a victim G (the age of 35) who causes the F Center’s business, instructs the victim G (the age of 35) to perform
At around 15:30 on July 16, 2014, the Defendant committed an indecent act against the victim by force by using the position to protect and supervise the victim's bucks in the Ebuck Park Park Seo-ri, which had been located in the Ebuck Park, Seo-ri, Gyeonggi-do, by taking advantage of the fact that the victim was unable to resist properly under the supervision of the defendant's business.
The Defendant, including this, committed an indecent act by force against a person subject to his/her protection and supervision on a total of 20 occasions from May 28, 2014 to September 24, 2014 due to his/her duties or other employment relationships, as shown in attached Table 1.
2. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall allow any person to reach another person repeatedly in the form of code, words, sound, image, or picture creating fear or apprehension through an information and communications network;
Nevertheless, on September 13, 2014, the Defendant called the above victim at a non-place on September 23:12, 2014, recorded and sent the victim’s voice message stating “I shall cut off, I shall be removed from the part of October 1,” and then called the victim’s voice message from September 10, 2014 to October 17, 2014, or called the victim’s victim’s voice.
