A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date the above judgment becomes final and conclusive.
Reasons
Punishment of the crime
As a workplace company of the victim B(33 years of age), the Defendant directed and supervised the victim on duty, such as guiding the victim with his/her duties or reporting the victim's attitude to his/her duties, and committed an indecent act against the victim, even if he/she commits an indecent act against the subordinate, he/she committed an indecent act against himself/herself, who is a superior, with the disadvantage in the workplace, making it difficult for the victim to take a problem.
1. On October 26, 2018, the Defendant completed the team conference in front of the “Cbuilding D” in Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu, Seoul, and committed an indecent act by force against a person under his/her protection and supervision due to his/her business relations, by having his/her two sides walked with the victim’s left side.
2. 4. On January 17, 2019, the Defendant: (a) around January 17, 2019, at the vicinity of the Gangnam-gu branch, the Defendant had the victim’s fluence of tobacco near the Gangnam-gu branch; (b) however, when the victim continuously refused it; (c) on the part of the victim, the Defendant’s fluence that “I am at the end of the after branch;”
