Reasons
Punishment of the crime
[Criminal Power] On December 10, 2010, the Defendant sentenced two years to imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Central District Court on December 10, 201, and completed the execution of the said sentence on October 19, 2012.
【Criminal Facts】
1. At around 18:00 on February 12, 2013, the Defendant acquired one copy of the Agricultural Credit Card Co., Ltd., which was lost by the victim C, in a club as one of the materials for life movement in Suwon-si, Suwon-si.
The defendant did not take necessary procedures such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On February 12, 2013, the Defendant purchased tobacco 1 A at the “F convenience store located in Seocho-gu Seoul, Seocho-gu, Seoul, and paid 2,700 won for the purchase of tobacco 2,70 won, the Defendant used the lost credit card by presenting it to an employee of the victim, as if he was the lawful holder of the said agricultural credit card, and the Defendant was the lawful holder of the said credit card, who was issued the tobacco 1 A from the employee, and acquired it by deceit.
B. On February 12, 2013, at around 20:48, the Defendant: (a) purchased one point of the sixth floor of G Building 6th 209 of Jung-gu Seoul Metropolitan Government and 14K boom at H stores; and (b) paid the price of KRW 815,000, the Defendant used a lost credit card in the same manner as provided in the preceding paragraph; and (c) obtained 14K box from the victim I, the main owner of the business, and acquired it by fraud.
C. On February 12, 2013, around 21:18, the Defendant used a lost credit card as referred to in the foregoing paragraph (a), and obtained a cigarette from an employee of the victim non-convenition store, in purchasing tobacco 1 A and paying 2,700 won.
