Defendant shall be punished by a fine of KRW 2,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

To the extent that there is no concern about substantial disadvantage to the defendant's exercise of his/her defense right, the facts charged are recognized as criminal facts.

1. On November 8, 2019, the Defendant: (a) held on the road near Jongno-gu Seoul Jongno-gu Seoul Metropolitan City B hotel on November 23:12, 2019, the credit card Co., Ltd. (hereinafter “the instant credit card”) owned by the victim C was lost.

After acquiring one Chapter, he/she did not take necessary procedures, such as returning the above victim, and he/she did so.

Accordingly, the Defendant embezzled the property that was separated from the possession of the above victim.

2. Fraud and violation of the Specialized Credit Finance Business Act;

A. On November 9, 2019, around 00:38, the Defendant purchased 1 to Blue tobacco from “F” in the operation of the victim E located in Jongno-gu Seoul Metropolitan Government D, and performed as if the said victim properly pays the amount, and paid 4,500 won with the instant credit card.

Accordingly, the Defendant used the lost credit card and by deceiving the said victim, received property amounting to 4,500 won.

B. On November 9, 2019, around 00:50, the Defendant purchased Rabba tobacco 2 A from “I” in the operation of the victim H located in Jongno-gu Seoul Metropolitan Government Jongno-gu G, and paid KRW 9,000 with the instant credit card, while doing so as to make a reasonable settlement to the employeeJ who worked there.

As a result, the Defendant used lost credit cards and by deceiving J, received property equivalent to the aggregate amount of KRW 9,000 owned by the said victim.

C. On November 9, 2019, at around 00:51, the Defendant purchased 8 Latn tobacco from “M” in the operation of the Victim L (M) located in Jongno-gu Seoul Jongno-gu Seoul K, and performed as if the said victims pay the amount properly, the Defendant paid KRW 36,000 with the instant credit card.

Accordingly, the Defendant used the lost credit card and received the total amount of 36,00 won by deceiving the said victim.
