A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On April 2, 2018, the Defendant, at around 14:30, found one of the card bags that the victim C lost at a closed-end Btel underground parking lot in Yeongdeungpo-gu, Suwon-gu, Suwon-si, 2018, but did not undergo necessary procedures, such as returning the acquired property to the victim.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Violation of Acts in financial business specializing in fraud and credit;
A. On April 2, 2018, at around 16:01, the Defendant purchased at KRW 159,200 the e “F” store located in Young-gu, Suwon-si, Suwon-si, the Defendant used a lost credit card by presenting one copy of the credit card bank, which was possessed by his/her employees under the same circumstances as described in paragraph (1), as his/her card, and received two e.g., 159,200 won from the said employee.
B. On the same day, the Defendant purchased 14 k bbles and arms, etc. at the same place around 16:07, at around the same day, and used the credit card lost by C as above, and received from an employee in the name of the Defendant, i.e., delivery of 1,60,800 k bbles and arms.

The Defendant continued to purchase at around 16:11 G stores located above E in the same day in KRW 99,00,000, and used the credit card lost by C as above, and received from the employees in the name of the Defendant one female-ray license equivalent to KRW 9,00,000 in the name of the Defendant.
3. The Defendant, who attempted to commit fraud on the same day, presented that one bank’s credit card, which was possessed by his/her employees due to the same circumstance as the description in paragraph 1, was his/her own card when purchasing 496,400 won of the H store located in the same day, and its employees are equivalent to KRW 496,400 from the above employees.
