A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
No person shall publish or have another person publish any false fact with respect to a candidate, his/her spouse, lineal ascendant or descendant, or sibling by means of a speech, broadcast, newspaper, communications, magazine, poster, propaganda document, or any other means, with the intention of prohibiting him/her from being elected.
Nevertheless, at around 07:00 on June 9, 2018, the Defendant editing news video images and posted them on the Internet bulletin board with the aim of preventing the election of the candidate E for the 7th nationwide City/Si/Gun election C from being elected at the Defendant’s office located in North Korea, around 07:0.
① On June 8, 2018, the Defendant downloaded news videos with the effect that “In the C election in which the money envelope case was set, D party-related parties came to the category of the G candidate behind the election and that G candidate raised suspicion of manipulation on the E candidate’s side,” which was broadcasted in the Ansan F around June 8, 2018 by using mobile phones.
② The Defendant, using a video editing program called “DUmer,” performed the compilation of news videos in a way that only left the part that “D party-related persons pay money in the event of a C election in which money bags are placed, and that they called “G candidates in front of the election.”
③ On June 9, 2018, at the same place as the Defendant’s mobile phone at around 08:07, the Defendant posted the news screen image, as seen above, as if the news was reported, under the title “K,” “K, by accessing HI, which is a social network service, to the Defendant’s mobile phone, and using the “J” on its bulletin board, that “K” was called “K.”
④ Furthermore, the Defendant, at around 08:39 on the same day, connected to H “L” at the same place, and, under the title “N” on its bulletin board, compiled in the same manner.
