A defendant shall be punished by imprisonment for not less than eight months.

On May 11, 2018, the Defendant was sentenced to two years and six months of imprisonment with prison labor and three years of suspended execution on May 19, 2018, and the judgment became final and conclusive on May 19, 2018.

가. 피고인은 2019. 9. 20. 23:40경 충북 음성군 B아파트 C호에서 조건만남 어플 ‘즐챗’을 통하여 성매매를 하기 위하여 만난 피해자 D(여, 20세)이 샤워를 하러 화장실에 들어간 사이 피고인이 소지하고 있던 휴대전화(LG Q6)를 주방 싱크대에 설치한 후 동영상 촬영 기능을 작동시켜 샤워를 마친 후 나오는 피해자의 나체를 피해자 몰래 3분 가량 동영상 촬영하여 성적 수치심을 유발할 수 있는 피해자의 신체 부위를 그 의사에 반하여 촬영하였다.

B. At around 22:10 on October 1, 2019, the Defendant: (a) opened a toilet door to engage in commercial sex acts in the B apartment C, and (b) sited in a shock, and taken the body part of the victim’s body, which might cause a sense of sexual humiliation, by photographing the body body of the victim two times after the victim’s sunset, by operating the dynamic image shooting function of the aforementioned mobile phone; and (c) taken against the victim’s will.

As described in the paragraph, I paid 150,000 won to D, and engaged in sexual intercourse once.

B. On October 1, 2019, the Defendant around 22:20, from the above B apartment C to 1.B.

As described in the paragraph, I promised D to pay 150,000 won to D in order to engage in sexual intercourse once.

On May 11, 2018, the Defendant was sentenced to two years and six months of imprisonment with prison labor and three years of suspended execution on May 19, 2018 by the Cheongju District Court for the crime of indecent act by force.
