Punishment of the crime

"2013 Highest 6288"

1. Around September 23, 2013, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Influence in public places) committed an act of intrusion on one column among 2 partitions of the public toilets of the first floor of the building located in Gangnam-gu Seoul, Seoul, with a view to meeting his/her sexual desire on September 23, 2013, and an act of taking the victim C (influence, 36 years of age) into the side column affected by the Defendant, with the knowledge that the victim C (influence, 36 years of age) was satisfyed, using a mobile phone with prior camera functions.

Accordingly, the Defendant infringed on public toilets, which are public places, for the purpose of meeting his sexual desire.

2. The Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Ameras, Useing and Screening of Cameras) taken video pictures for about one minute and 13 seconds from a cell phone with the function of a camera owned by the Defendant at the same time and time as the foregoing at the same time and place as the preceding paragraph.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using a camera against his will.

1. Around November 13, 2013, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Influence in public places) taken a cambling screen with a cambr in a toilet in Mapo-gu Seoul Metropolitan Government, for women to take a cambine in order to have a cambine reported by entering the toilet, and waiting for the subject by intrusion into the toilet. A female victim was in possession of a cambr in advance with a cambr in the toilet.

Accordingly, the Defendant infringed on public toilets, which are public places, for the purpose of meeting his sexual desire.
