『2020고단2373』 피고인은 2019. 10. 19.경 인천 부평구 H건물 I호에서, 인터넷 중고거래 사이트인 J에 접속하여 ‘에어팟을 판매한다’는 취지의 글을 게시하고, 이를 보고 연락한 피해자 E에게 ‘150,000원을 입금하여 주면 에어팟을 보내주겠다’는 취지로 말하였다.

그러나 사실 피고인은 에어팟을 가지고 있지 않았으므로 피해자로부터 판매대금을 입금 받더라도 위 물건을 보내줄 의사나 능력이 없었다.
