A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 12, 2016, the Defendant was issued a summary order of KRW 3,50,000 as a fine for a violation of the Road Traffic Act at the Suwon District Court’s Eunpyeong Housing Sitewon for a violation of the Road Traffic Act.

1. Around 00:19 on April 10, 2020, the Defendant driving a vehicle E in the state of alcohol with blood alcohol concentration of 0.177% on the same day at a Ccafeteria parking lot located in the wife-population B of Yong-si around the same day, at around 01:43, the Defendant driven a vehicle while under the influence of alcohol with blood alcohol content of 0.177%.

2. 공무집행방해 피고인은 2020. 4. 10. 01:43경 용인시 처인구 D 앞 도로에서 위 코란도 차량의 운전석에서 잠을 자고 있던 피고인이 음주감지기를 통해 술을 마신 사실이 확인되어 용인시 처인구 F에 있는 용인동부경찰서 G파출소로 간 후, 같은 날 02:12경 위 G파출소 내에서 혈중알콜농도 0.177%로 음주측정되었으며, 음주측정 경찰관인 H파출소 소속 I 경사가 피고인에게 면허 취소 수치가 나왔다는 것을 고지하면서 인적사항을 확인하려고 하자, ‘씨발! 가만히 있는 사람 왜 건들고 지랄이냐고!’라고 소리를 지르면서 ‘네가 뭘 안다고 씨발! 너희들 내가 협조 안 할 거니까 알아서 해! 내가 운전하지도 않았고! 내가 운전하다가 너한테 걸렸니 ’라고 하였고, 갑자기 자리에서 일어나 ‘씨발, 야!’라고 하면서 오른손 손바닥으로 위 I 경사의 얼굴을 강하게 밀고, 옆에 있던 H파출소 J 순경이 피고인의 행동을 제지하자 피고인은 오른손으로 위 J 순경의 얼굴을 밀었다.

Accordingly, the defendant assaulted two police officers, thereby obstructing the legitimate performance of official duties for handling 112 reports and measuring drinking alcohol.
