A defendant shall be punished by imprisonment for one year.

However, the defendant shall be sentenced to the above punishment for a period of two years from the date this judgment becomes final and conclusive.

A on December 28, 2015, in the Busan District Court Branch of the Incheon District Court, was sentenced to a two-year suspended sentence of imprisonment for special larceny for 8 months, and the said judgment became final and conclusive on January 5, 2016, and is currently under suspended sentence.

On December 27, 2015, the Defendant: (a) committed theft with C, together with C, with a new card owned by the victim F on his/her book at EPC located in Songpa-gu Seoul, Songpa-gu, Seoul; (b) a son’s mother’s national card owned by the victim G; and (c) a part of a wall with which the victim F’s market price cannot be identified.

2. A defendant who violates the Act on Financial Business Specializing in Fraud or credit finance in collusion with C;

A. On December 27, 2015, around 04:08, at the H convenience store for the victim’s operation of which the name located in Songpa-gu Seoul Metropolitan Government is unknown, the Plaintiff purchased a tobacco amounting to KRW 4,500, the market price of which is equivalent to KRW 4,500, and paid with a stolen card, thereby acquiring tobacco from the injured party and using a stolen credit card.

B. On December 27, 2015, around 04:09, at the places indicated in the foregoing paragraph (a) and at around 45,000 won of tobacco purchase, the market price of which is equivalent to 45,000 won, and settled with a stolen national card, thereby acquiring tobacco from the injured party, and using a stolen credit card.

On December 27, 2015, around 04:13, 2015, at the convenience point in the operation of the victim with no knowledge of the name in Songpa-gu Seoul Metropolitan Government I, the victim purchased 1 universal tobacco equivalent to the market price of 45,000 won, and paid by means of a stolen national card, thereby defrauding the tobacco from the victim, and using a stolen credit card.

On December 27, 2015, around 04:25, at the places described in the foregoing paragraph (c), and at the market price of KRW 45,00,000, the Plaintiff purchased tobacco from the injured party by means of a stolen national card, and paid it by such means as above, acquired tobacco from the injured party and used the stolen credit card.
