A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a person who has been elected in the election of a standing director of an agricultural cooperative in January 31, 2012 and is currently in the position of the standing director of the association.

1. No person who provides goods to a member of the personnel recommendation committee, etc. shall provide money, goods, entertainment, or other property benefits to a member or his/her family members for the purpose of having him/herself or a specific person elected or not elected as an executive or representative of a local agricultural cooperative;

Nevertheless, the Defendant, prior to the pro-con voting for the election of the standing director of the said Nonghyup, which was held on January 31, 2012, sentenced to the recommendation by the Standing Director Personnel Recommendation Committee held on the 13th day of the same month, had the intent to provide a set to the executives, etc. who are likely to be included in the members of the Standing Director Personnel Recommendation Committee, for the purpose of final election.

On December 26, 2011, the Defendant, at the above partnership office located in Kimhae-si, could be included in the members of the above personnel recommendation committee, and the Defendant sent 7 directors, such as F, etc., who are members of the board of directors of the above partnership that determined members of the personnel recommendation committee, using one set of 270,000 won at the market price and one set of 1,000 won at their domicile.

B. On January 7, 2012, the Defendant knew that G and H, a representative, were included in the members of the said personnel recommendation committee, and even to them.

In the same way, the market price of 270,000 won was provided in 1 set.

Accordingly, the defendant provided nine members, such as the personnel recommendation committee, with goods of total amount of KRW 2,430,000,000 as shown in the attached list of crimes for the purpose of election.

2. A person who gives entertainment to, or expresses his/her intention to offer money or goods to, a member of a personnel recommendation committee shall be a member or his/her family, etc. for the purpose of getting himself/herself or a specific person elected as an executive officer or representative of a local agricultural cooperative, or not being elected.
