[Defendant A] The defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is a person who helps another person to carry out an election campaign of G that goes as a candidate for the members of the Busan Metropolitan City captain-Gun Council of the 6th regional election, and Defendant B and C are the electors who reside in H apartment of Busan Metropolitan City captain-Gun (hereinafter “instant apartment”).

1. Defendant A

(a) No one shall offer, express an intention to offer, or promise, instruct, induce, mediate, request or receive any money, goods, or other benefits in connection with the election campaign regardless of the pretext such as allowances, actual expenses, other compensation for volunteer service, etc., except where he/she provides allowances, actual expenses, or other benefits related to the election campaign under the Public Official Election Act;

Nevertheless, the Defendant provided money and valuables in relation to the election campaign for the general candidate as follows.

1) On April 2014, the Defendant provided KRW 200,000 in cash to the elector B residing in the apartment of this case, who was a resident of this case and the former president, within the Defendant’s passenger car that was set up on the port side of Busan Shipping Daegu Maritime Affairs and Fisheries, with “I will come back at Gunwon at once. I will present my opinion well. I will present my opinion. I will want to do so. I will deliver a cash of KRW 200,000 upon the request that I would deliver an election campaign for the candidate. (2) On April 2014, the Defendant provided the elector B residing in the apartment of this case with “I would like to have been engaged in an election campaign for the Gu candidate.” It means that I would have provided the elector B residing in the apartment of this case with KRW 100,000 in cash upon request for an election campaign.”

3. Within the Defendant’s car that was set up at the entrance of the apartment of this case in early May 2014, the Defendant: “B helps any elector residing in the apartment of this case,” and L she shall be on the wind coming from the seat of his or her seat.
