A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On April 13, 2012, the Defendant was sentenced to imprisonment with prison labor for night buildings, theft, etc. at Jeju District Court on April 13, 2012, and on May 28, 2013, the Jeju Prison completed the execution of the sentence.
1. A thief: (a) around June 22, 2013, around 21:00, the Defendant: (b) went to the E entertainment tavern for the victim of the first floor C underground in Jeju; (c) went to the E entertainment tavern of the victim; and (d) brought the victim a gap in the victim’s outing; (c) 800,000 won in cash owned by the victim in his/her singing room; and (d) 200,000 won in a household market with one credit card.
2. On June 23, 2013, the Defendant violated the Specialized Credit Financial Business Act: (a) around 01:59, the Defendant placed an order for the victim G operation “H” in the victim G Ha, which was located in Jeju Island, to pay a normal price if he/she received an order, such as a performance, alcohol, and alcohol.
However, the defendant thought that he would pay the drinking value using a stolen credit card as above, and there was no intention or ability to pay the drinking value normally.
As such, the Defendant, by deceiving the victim, received alcoholic beverages equivalent to KRW 100,000 from the victim. The Defendant presented the stolen credit card to the victim who demanded the payment of the purchase price, and paid KRW 100,000 for alcoholic beverages.
Accordingly, the defendant, by deceiving the victim, received alcoholic beverages equivalent to 100,000 won, and used stolen credit cards.
In addition, the Defendant, from the same day to 05:07 on the same day, by deceiving the victims on seven occasions in total, as shown in the attached Table 1, and was provided with alcoholic beverages worth 1.1 million won in total from the victims, and used stolen credit cards.
3. On June 9, 2013, around 04:30, the Defendant committed fraud at the “K” station located in Jeju Island, where the victim J was operated, as if the Defendant would normally settle the price by having the beer, at the time of drinking.
However, the defendant is normal to pay the price.
