Defendant shall be punished by a fine of 1.5 million won.

Reasons
Punishment of the crime
1. On September 14, 2017, the Defendant: (a) stolen the victim’s galone mobile phone in the victim’s gallon case; (b) one cellular phone in the victim’s gallon case; and (c) one copy of the national bank’s credit card and 50,000 won in cash, which were located on the victim’s gallon in the instant mobile phone case, using the gaps in which surveillance of the victim’s E was neglected; and (d) the victim’s gallon case was stolen.
2. Violation of Acts in financial business specializing in fraud and credit;
A. On September 14, 2017, the Defendant purchased a 3:00 won of the price of the goods at around 18:51 on September 14, 2017, the Defendant, as seen in paragraph (1) of the said Article, to pay the price, presented the name of the national bank in the name of the above E, as if he/she had a right to normally settle the credit card of the national bank in the name of the above E, as if he/she had a right to normally settle the price, and thereby, had the said employee pay 15:00 won of the price of the goods, thereby barring the said employee from paying the price of the goods.
In this respect, the Defendant acquired property benefits equivalent to 15,000 won using stolen credit cards.
B. On September 14, 2017, the Defendant: (a) purchased apologys at the K branch of the victim J’s operation of Jung-gu Seoul Special Metropolitan City, Jung-gu; (b) on September 14, 2017, the Defendant: (c) presented it to the employees, as if he/she had the right to normally settle the credit card of the national bank in the name of the above E, as stated in paragraph (1) of the above paragraph; and (d) thereby allowing the said L to pay KRW 18,000 for the price of the goods; (c) thereby, exempted the said L from paying the price of the goods.
In this respect, the Defendant acquired financial benefits equivalent to 18,000 won using stolen credit cards.
