A shall be punished by imprisonment with prison labor for ten months and by imprisonment for eight months, respectively.

Punishment of the crime

A person, other than a marina society, shall not engage in any act similar to a riding vote, in connection with a racing conducted by a marina society, to pay property or financial benefits to the winners of such racing.

On October 24, 2014, the Defendants conspired to operate a private horse race track by leasing the “E Office” operated by D (Demand for Summary Order) located in Thai-si, Thai-si to D with KRW 1.50,000 per week.

From October 24, 2014 to November 9, 2014, the Defendants: (a) at the same place for nine days (Friday, Saturdays, Sundays) during the nine-day period from October 24, 2014; (b) had access to a ID and password delivered to a private Internet horse website (F) by a computers located therein; and (c) had access to a horse operated by G, H, I, J, K, K, L, M, D (Demand for Summary Order) from the due date to the due date, the Defendants returned the right to use the horse in cash to the enemy, and completed the operation of the horse race track from October 1 to 10 to the due date.

As a result, the Defendants conspired with others to commit an act similar to the horse riding voting in relation to the racing conducted by a marina society while not being a marina society, and caused others to pay money or property benefits to the public.
