A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
The Defendant: (a) forged another person’s identification card from “C” to obtain a loan from a financial institution; (b) received a proposal from a third person to make a signature on a loan document, and accepted the proposal as a fee, with the signature of KRW 50 million.
1. On December 2, 2012, the Defendant forged official document: (a) at a mutually influent restaurant located in the Suwon-si, Suwon-si; (b) the Defendant hereinafter “C”); (c) placed his/her photograph on a single-person “C”; (d) attached the Defendant’s photograph by an influence method; and (d) forged his/her resident registration certificate on which the official seal of the safe market is affixed.
Accordingly, the Defendant forged the resident registration certificate of D in the name of the safe market name of the official document for the purpose of uttering in collusion with the name of "C".
2. The Defendant presented that, at around 15:00 on January 10, 2013, FF associations located in Chungcheongnam-gun, Hongsung-gun, Hongsung-gun, the Defendant issued D’s resident registration certificate, which is a forged public document, as in paragraph 1, to G in the course of preparing a loan document.
Accordingly, the Defendant, in collusion with “C”, exercised a forged official document.
3. The Defendant forged a private document stated in the column of “D, I, and Gyeonggi-do In order to provide joint and several sureties applications for a loan of KRW 1 billion and KRW 1.7 billion each of the debtor H and loans at the same time and place as described in paragraph 2, and stated in the column of “D, I, and Gyeonggi-do In order to provide joint and several sureties,” and written in the column of the contents of the application “D, I, and the JJ in Ansan-do,” and written in the column of the contents of the application, “D’s seal prepared in advance in D’s name,” stating “D’s seal” in the applicant column, and written in the same manner “D’s joint and several sureties application amount.”
Accordingly, the Defendant, in collusion with the name “C”, is a private document related to rights and obligations for the purpose of uttering.
