피고인은 2014. 4. 21. 00:00경 서울 강북구 노해로 42 한라부동산 앞 노상에서 영업용 택시에 승차하여 목적지로 향하던 중, 피해자인 택시기사 B(55세)에게 욕설을 하였고, 욕설을 들은 피해자가 위 승차 장소에 되돌아가 112 신고로 출동한 경찰관인 경위 C 등과 행인들이 보는 앞에서 ‘개새끼야, 좆같은 새끼야, 맞짱 뜨자, 씹할놈아’라고 욕을 하고, 이를 제지하는 경찰관인 피해자 D(32세)에게 ‘씨팔 새끼들, 병신새끼들, 니 몇살이냐, 개새끼야, 너 죽여 버릴거야’라고 10여분간 욕설을 함으로써 공연히 피해자들을 모욕하였다.
