A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On October 28, 2010, the Defendant made a false statement to the effect that “The Defendant, by telephone, lent 2 million won to the victim V as soon as possible, on the part of the victim V at an insular place.”
However, the defendant had no particular property at the time, and borrowed money was thought to be used for the purpose of repayment of debts, and even if he borrowed money from the victim, he did not have an intention or ability to repay it.
As such, the Defendant: (a) by deceiving the victim as such; (b) received on October 28, 201, KRW 1500,000 from the victim to the account in W’s name; (c) received KRW 500,000 from November 2, 2010 to the account in X’s name, his/her father; and (d) received on February 21, 201 in the same manner, the amount of KRW 1 million to the account in the above X’s name; (c) received KRW 23 million on June 27, 2011; and (d) received KRW 1 million on November 28, 201, KRW 100,000 on August 23, 201; and (e) received KRW 600,000 on August 24, 201 under the name of the victim in the false name, and delivered KRW 701,500,000 on August 24, 2011.
2. On December 6, 2011, the criminal defendant against the victim AB made a false statement to the effect that "the victim would pay the victim money for investment in fishery products business, etc." to the victim at the victim AB's residence located in the Gunssan-si AC in the Gunssan-si.
However, the Defendant had no particular property at the time, and the invested money was thought to be used for the purpose of living expenses, etc., and even if receiving the investment money from the victim, there was no intention or ability to return the principal.
As such, the Defendant, by deceiving the victim and deceiving him/her as such, to make investments from the victim on December 6, 201, KRW 13 million, KRW 7 million on December 12, 201, KRW 3 million on December 16, 201, KRW 200,000 on December 16, 201, KRW 200,000 on December 23, 201, and KRW 5,01 on January 5, 2012.
