1. Fraud;

A. A. Around January 17, 2017, the Defendant against the victim B made a false statement to the victim B, stating that “The victim B would have a high profit rate. In this case, the Defendant would guarantee the principal and 8.2% return rate.”

However, there was no such investment product, and at the time, the defendant had been able to pay the individual debt or use it as living expenses with money from the victim because of the failure to return the investment principal due to the failure to make an investment.

Ultimately, the Defendant, by deceiving the victim as above, received KRW 35 million from the victim’s account in the name of the Defendant to the E bank account in the name of the Defendant.

B. Around January 23, 2018, the Defendant against the victim F made a false statement to the victim F by communicating the victim F by telephone, stating, “The principal may be guaranteed with U.S. bonds. In making an investment in U.S. bonds, the principal and interest will be guaranteed and 4.25% profits will be guaranteed.”

However, there was no such investment product, and at the time, the defendant had been able to pay the individual debt or use it as living expenses with money from the victim because of the failure to return the investment principal due to the failure to make an investment.

Ultimately, the Defendant, by deceiving the victim as above, received KRW 3 million in total from the victim’s Gsecurities account (H) in the name of the Defendant on the same day, KRW 1.6 million in the same account on February 26, 2018, KRW 1.6 million in the same account on July 12, 2018, and KRW 700,000 in the same account on October 11, 2018.

2. Forgery of private documents;

A. The first Defendant committed the crime at the foregoing D office around January 17, 2017.
