피고인들은 2015. 4. 중순경부터 2015. 5. 21. 경까지 위 게임 랜드에 ‘ 고 인돌’ 게임 기 45대, ‘ 흑룡’ 게임 기 10대, ‘ 하제’ 게임 기 30대, ‘ 엠티’ 게임 기 10대 등 총 95대의 게임기와 게임기 버튼을 자동적으로 눌러 주는 ‘ 똑딱이 ’를 구비하여 손님들의 이용에 제공하였다.

위 게임 물들은 모두 ‘ 포커’ 규칙으로 진행되는 것으로, 손님이 게임기 하단의 지폐 투입구에 10,000원 권 지폐를 투입하면, 게임기 화면 좌측 하단의 'CREDIT‘ 창에 10,000점이 생성되고 ’ 똑딱이 ‘를 시작 버튼 위에 올려 두면 자동적으로 시작 버튼을 눌러 1회 100점 내지 200점 씩 베팅을 하여 화면 속에 있는 5 장의 트럼프 카드가 오픈되며 우연의 결과에 따라 점수를 취득하고, 취득한 점수는 화면 우측 하단 ’BANK' 창에 적립되게 된다.
