4. 30. 경까지 대전 유성구 C 건물 1 층에서 ‘D’ 을 운영하면서, 청소년 이용 불가 비 경품게임인 ‘ 이모션 포커’ 게임 기 40대를 설치하고, 위 게임기의 ‘START' 버튼을 자동적으로 눌러 주는 속칭 ’ 똑딱이‘ 장치를 구비한 후, 그 곳을 찾은 손님들이 500 원권 동전 20개를 위 게임기에 투입하면 위 게임 화면 좌측 하단 ’CREDIT' 창에 10,000점이 생성되고, 위 ‘ 똑딱이’ 장치를 위 게임기 ‘START' 버튼 위에 올려놓으면 위 게임이 자동으로 실행되어 1 게임 당 100점 감소하며 우연한 결과에 따라 위 게임 화면 속에 5 장의 카드의 그림 및 숫자의 조합이 바뀌면서 그 정해진 규칙에 따라 최소 100점에서 최대 200,000점까지 점수를 획득하고, 그 점수는 위 화면 우측 하단 ’BANK' 창에 적립이 되어 위 ‘BANK' 창에 적립된 점수를 이용하여 게임을 실행할 수 있고, 손님들 로부터 위 ’BANK' 및 ‘CREDIT' 창에 적립된 금액의 반환을 요구 받으면 그 해당 점수를 점수 보관기능이 포함된 무기명 전자식 카드에 입력하여 발행해 줌으로써 위 카드에 저장된 점수만큼 다시 게임을 할 수 있도록 하여 카드에 입력된 금액 상당의 교환가치를 부여하고, 손님들 상호 간 수수료 명목으로 20%를 공제하고 현금으로 환전하는 행위를 알고도 방 치하였다.
