A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence 1 or 2 shall be confiscated.

1,100,000 won from the defendant.

Punishment of the crime

On July 22, 2015, the Defendant was sentenced to imprisonment for one year with labor for a violation of the Narcotics Control Act in the Busan District Court’s Vice Branch branch on July 2, 2015, and completed the execution of the sentence in Gwangju Prison on June 12, 2016.

Despite the fact that the Defendant is not a narcotics handler, he dealt with the Metepha (one philopon; hereinafter “philopon”) which is a local mental medicine as follows:

1. On January 1, 2018, the Defendant: (a) received a request from C to request the c to request the opononon from around 21:00 to 23:00; (b) sold opon in cash from C at one’s own residence of Michuhol-gu, Incheon; (c) 500,000 won in cash from C; and (d) sold opon in a transparent vinyl package by reporting two grams of opon.

2. Medication of phiphones.

A. On April 20, 2018, between around 21:00 to 22:00, the Defendant injected approximately 0.1g of philopon purchased from a person who has no name in his/her own residence in Michuhol-gu, Michuhol-gu, Incheon, B, and 605, in a single-use injection machine (a single-use injection machine) and dilution with a bio-use water, and administered them by means of injection to his/her right wings.

B. On May 8, 2018, the Defendant administered approximately 0.1g of philophonephones purchased from a person who was not aware of his name at the same place as the above paragraph (a) at around 21:0 to 22:00, in the same manner as the above paragraph (a).

(c)

On May 14, 2018, between around 21:00 to 22:00, the Defendant administered approximately 0.1g of philophones purchased from a person who has no name, at the same place as the above paragraph (a) in the same manner as the above paragraph (a).

(d)

On May 22, 2018, the Defendant administered approximately 0.1g of philophones purchased from a person who has no name in the same place as the above paragraph (a) at around 21:00 to 22:00, in the same manner as the above paragraph (a).

E. On May 25, 2018, the Defendant: (a) purchased philophones from a person who has no name from around 21:00 to around 22:00, at the same place as the foregoing paragraph (a).
