Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
Part of the facts charged shall be revised and explained according to the facts found by evidence.
1. A theft Defendant: (a) around 15:40 on November 15, 2014, at a bank located in Gangnam-gu Seoul, Gangnam-gu 357, the victim B laid one cellular phone (one million won at the gallon S3 market price) into a cash payment season; and (b) stolen the victim B’s cell phone by using it as a string place.
2. On November 29, 2014, the Defendant found one credit card in the name of mother F of the victim E (the age of 14) who satisfing in front of the D cafeteria located in Dobong-gu Seoul Metropolitan Government, around November 29, 2014.
The Defendant, without taking necessary procedures such as returning the acquired property to the victim, embezzled the property that left possession by admitting that he/she had, without taking necessary procedures.
3. Violation of the Specialized Credit Financial Business Act;
A. On November 29, 2014, around 14:17, the Defendant purchased goods equivalent to KRW 16,050 from the “H convenience store” on the first floor of the Dobong-gu Seoul Metropolitan Government G building, and purchased goods equivalent to KRW 16,050, such as liquor, etc., and had an employee I prepare sales slips by presenting a new credit card under the name of F, as mentioned in the foregoing paragraph (2), and used the stolen credit card by signing and delivering it at his/her own discretion.
B. On November 29, 2014, the Defendant purchased a half of the amount equivalent to KRW 195,00 from K “K” located in Dobong-gu Seoul Metropolitan Government J on November 29, 2014, the Defendant offered a new credit card in the name of F that stolen as prescribed in the foregoing paragraph (2) and used a stolen credit card by signing and delivering the sales slip at will.
C. On November 29, 2014, at around 14:36, the Defendant purchased goods equivalent to KRW 31,100 from “NV” located in Dobong-gu Seoul Metropolitan Government M, including ham, etc., and offered a stolen credit card under the F, such as the foregoing paragraph (2), and used the stolen credit card by arbitrarily signing and delivering it on that part.
