Punishment of the crime

1. 2015 Highest 1495;

A. The Defendants, around February 14, 2015, found that around 23:40 on February 14, 2015, the Defendants acquired a lot card (credit number F) owned by the victim E, which was lost on the road before Dobong-gu Seoul Metropolitan Government D.

The Defendants did not follow necessary procedures, such as returning the acquired property to the victim, but did so.

As a result, the Defendants conspired in collusion and embezzled the property that was separated from the possession of the victim.

B. On February 14, 2015, the Defendants in violation of the Luxembourg Fraud and the Specialized Credit Financial Business Act suggested that, at the “H convenience store operated by the victim’s name in Dobong-gu Seoul Metropolitan Government, the E card acquired as referred to in paragraph (1) was presented to the victim as if the victim was his/her own card, and that she was using the lost credit card by purchasing from the victim the tobacco amounting to 27,000 won in total at the market price, having the victim prepare the sales slip, and signing and submitting it to the victim, and then using the lost credit card by signing and submitting it.

From around that time to February 15, 2015, the Defendants conspiredd with 10 times from around that time to February 15, 2015, 175,400 won in total by deceiving victims, and used lost credit cards.

B. On February 15, 2015, around 02:44, Defendant A’s sole criminal defendant’s “J convenience store” operated by the victims of the victim’s name in Dobong-gu Seoul Metropolitan Government I.
