피고인은 2016. 5. 14. 22:00경 서울 용산구 C에 있는 ‘D’ 음식점 앞길에서 위 음식점 종업원과 손님에게 욕설을 하며 행패를 부리고 있다는 112신고를 받고 출동한 서울용산경찰서 E지구대 소속 경찰관 F 등으로부터 제지당하자 화가 나 “야 이 씨발 놈들아, 내가 옛날에 경찰들 많이 때렸다, 좆같은 새끼들아, 이 씨발 놈들아.”라는 등으로 욕설을 하며 F을 향해 주먹을 휘두르고 양손으로 F을 밀치고, 발로 F의 정강이 부위를 걷어찼다.

이후 피고인은 같은 날 22:20경 서울 용산구 G에 있는 E지구대에서 위와 같이 공무집행을 방해하였다는 피의사실로 현행범인 체포되어 있던 중 그 곳에 있던 위 지구대 소속 경찰관 H이 다가오자, “이 씨발 개새끼들아, 좆같은 경찰새끼들아, 또 때려줄까.”라고 욕설을 하며 발로 H의 정강이 부위를 걷어찼다.
