A defendant shall be punished by imprisonment for not less than eight months.

An applicant for compensation shall be dismissed.

Punishment of the crime

"2015 Highest 3492"

1. On May 24, 2015, the Defendant posted a letter stating that he sells cultural product rights on the “Niber’s” website, which is the Internet evasion site, and reported and contacted the above letter to the victim D, who read that “The amount equivalent to KRW 500,000 shall be sold at KRW 415,000.”

However, as the defendant did not have the right to sell cultural products at the time, even if he received the money from the victim, he did not have the intention or ability to sell cultural products.

The Defendant received KRW 415,00 from the victim as the price for goods and received KRW 1,428,00 from the victims in total on 13 occasions from July 23, 2015, as shown in the attached Table of Crimes (1) from July 23, 2015.

Accordingly, the defendant was provided property by deceiving the victims.

2. The fact that the defendants are not holding cultural products rights has no intention or ability to sell cultural products even if they are paid the prices;

Nevertheless, the Defendant, at around July 22, 2015, connected to the Nam-gu Seoul building and the Defendant’s house located in 103, posted a letter that “I will sell cultural merchandise coupons at a selling site of the Internet used goods,” and reported it to the victim F who had contacted with the Defendant, and received KRW 44,000 as the price for the same day from the said victim.” The Defendant received KRW 44,000 from the said victim.

Accordingly, the defendant was given property by deceiving the victim.

3. On September 19, 2015, the Defendant posted a false notice stating that “I will sell one sheet of KRW 100,000,000 on the Internet NAVER at a non-place on the Internet and then sell it to KRW 86,00,00,” and then, from the victim G who reported and contacted the above writing.
