Punishment of the crime

[2017 Highest 2871] On July 10, 2017, the Defendant posted a letter stating that “The sale of cultural merchandise coupons” in “CCCCP,” which is an Internet portal site, and said, the Defendant said that “the sending of money to the victim D who had contacted with the Internet portal site,” and said, “the sending of money.”

However, the defendant did not have cultural products rights and did not have any intention or ability to sell them even if he receives payments from victims D.

Nevertheless, the Defendant deceiving the victim D as above, and received KRW 40,00 from the victim D to the EF bank account (G) in the name of the Defendant on the same day from the victim D as the price for goods, and received KRW 6,308,793 in total over 39 times from around that time to July 25, 2017 in the attached crime list as shown above.

Accordingly, the defendant acquired the victims' property by deceit.

[2018 Highest 371] On July 11, 2017, the Defendant posted a letter to the Internet B “C” page, and made a false statement to the effect that “The Defendant would send the machine container to the victim H who contacted with the “20,000 won.”

However, the defendant did not have the intention or ability to sell the goods even if he received money from the victim.

The Defendant, by deceiving the victim as above, received 20,000 won from the victim’s bank account in the name of E, the same day.

[2018 Highest 541] On July 19, 2017, the Defendant sold a cultural product right by accessing a cell phone from the Defendant’s house located in I and II to Internet “C” online.

The author puts up a false statement to the victim J who has reported and contacted the 40,000 won, stating that “The right to receive cultural products shall be sent if deposit is made.”

However, in fact, the defendant does not possess anything and receives money from the victim, but sells it.
