A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around January 8, 2018, the Defendant: (a) posted a false statement to the effect that “I will sell a mobile phone, etc.” on the bulletin board “I will sell a mobile phone, etc.” without any intention or ability to sell the goods; (b) received a false statement to the victim C who reported the false statement to the effect that “I will send the goods if you deposit the purchase price of the goods” from the victim to the D account (E) in the name of the Defendant from the victim.
In addition, from around that time to May 20, 2018, the Defendant acquired a total of KRW 3,209,500 as shown in the attached crime list.
Around January 27, 2018, the Defendant posted a notice on the B bulletin board stating that he/she would sell APD (iPD) and that he/she would send APD to the victim F, who reported and contacted the deposit of money, with the victim F, with the intention of sending APD as a door-to door.
However, there was no intention or ability to sell it to the victim because the defendant did not have the above aide.
As above, the Defendant, by deceiving the victim, received 630,000 won from the victim to the H bank account (I) in the name of G on the same day.
The Defendant, “2018 Highest 4132,” posted a letter on the B Kaf, a transaction site of secondhand goods online, that sells cultural products using the said ID.
However, the defendant did not have any intention or ability to sell cultural products even if he receives money from the victims in the name of purchasing cultural products rights.
1. On July 8, 2018, the Defendant received KRW 27,000 from the victim L, who reported and contacted the above writing, to the effect that “The Defendant would transmit the money to a cell phone the fin number of the goods from which the money was remitted to the cell phone.”
