A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 31, 2020, the Defendant posted a false statement to the effect that he sells cultural products by accessing the “B” display using a mobile phone despite the lack of intent or ability to sell cultural products, and received text messages from the victim C who made contact with the Defendant as if he sold cultural products rights, and received KRW 26,100 from the victim’s bank account in the name of the Defendant around 14:41 on the same day.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

On April 11, 2020, the Defendant sent a false statement to the victim G that he would sell F Game money KRW 1 billion.

However, even if the defendant receives the price, he did not have the intention or ability to sell the game money to the victim.

Nevertheless, the Defendant, as seen above, received KRW 34,00 in total from around 13 times to September 14, 2020 by means similar to the list of crimes in the annexed Table 1, as well as from around 34,000, by deceiving the victim and receiving KRW 34,000 from the corporate bank account (J) in the name of the victim.

Around August 3, 2020, the Defendant, “20 Man-Ma8994,” up to August 3, 2020, posted a letter to the Internet B using a mobile phone at the residence of the suspect of Bupyeong-gu, Incheon, Bupyeong-gu, Incheon, stating that “The sale of cultural merchandise tickets” was made, and that “the transfer of money would be made if money is wired.”

However, in fact, the defendant received money from the victim and thought to use it for the cost of living, and there was no intention or ability to send cultural products equivalent to the money transferred to the victim.

The defendant deceivings the victim as above and is deceiving him.
