피고인은 2012. 8. 2.경 보령시 C아파트 301호에 있는 피고인의 주거지에서 인터넷 사이트 미디어 다음(http://www.media.daum.net)에 컴퓨터를 이용해 접속한 후 대통령후보자 D를 당선되지 못하게 할 목적으로 위 사이트 게시판에 “도적놈이 옷 갈아입고 이름 바꿨다고 도적질 안할 줄 알았냐, 애비가 강탈한 재산 바지사장 대신 앉아 놓고 오리발 내미는 사람이 그 집단 대장인데“라는 내용의 글을 게시하는 방법으로 공연히 사실을 적시하여 후보자를 비방하는 등 별지 범죄일람표와 같이 그 무렵부터 2012. 8. 29.경까지 총 12회에 걸쳐 대통령후보자 D에 대하여 당선되지 못하게 할 목적으로 공연히 사실을 적시하여 후보자를 비방하였다.
