Punishment of the crime

No person shall slander a candidate (including a person who intends to become a candidate) or his/her spouse, lineal ascendant or descendant, or sibling by openly pointing out facts through a speech, broadcast, newspaper, communications, magazine, poster, propaganda document, or any other means, with the intention of getting elected or getting another person to be or not to be elected.

그럼에도 불구하고 피고인은 18대 대통령 선거 C당 예비후보자였던 D를 당선되지 못하게 할 목적으로, 2012. 7. 13. 인터넷 사이트 ‘다음’의 ‘아고라 정치토론방’에서 ‘E’라는 아이디로,『제목: 외국 언론은 독재자 딸년이 대통령 후보 출마한다고 비웃던데 선진국에선 기본적으로 독재자 딸년이 대통령 후보 출마 자체가 말이 안되지만 우리나란 돈에 눈멀고 대가리 나쁜 수꼴버러지들이 많아 가능!!! 독재자 딸년이 대통령 후보 출마라니 닥년 때문에 쪽팔린다. 쪽팔려∼』라는 글을 게시하여 공연히 사실을 적시하여 D 후보자를 비방한 것을 비롯하여 2012. 8. 3.경까지 23회에 걸쳐 별지 범죄일람표 기재와 같이 공연히 사실을 적시하여 D 후보자를 비방하였다.
